within the scope of its activities, manages and processes personal data of the following subjects. This personal data processing policy (hereinafter referred to as the “Policy”) informs data subjects about the circumstances of the processing of their personal data and the rights they have in relation to this processing.

1. DATA SUBJECTS, PURPOSES, SCOPE, DURATION AND LEGAL BASIS FOR PROCESSING

A. PERSONS CONTACTING THE CONTROLLER
The Controller processes personal data of persons who contact the Controller by e-mail, telephone or via the contact form for the following purposes, scope, legal reason and duration:
Purpose: Answering the enquiries of the enquirer.
Scope of the data: name, surname, e-mail address, telephone number.
Legal basis: Legitimate interest in receiving an answer.
Duration: Necessary to answer the query.

B. PERSON SIGNING UP FOR NEWSLETTER SUBSCRIPTIONS TO THE ADMINISTRATOR
The Administrator processes the personal data of persons who give the Administrator consent to receive newsletters (commercial communications) for the purpose, scope, legal reason and for the following periods:

Purpose: Sending commercial communications for marketing and advertising purposes.
Scope of data.
Legal reason: Consent.
Duration.

 

C. VISITORS OF THE WEBSITE
The controller carries out the processing of cookies in relation to visitors to the website.

Cookies are text files containing a small amount of information that are downloaded to the website visitor’s mobile phone, computer or other device when they visit the website. Each subsequent visit to the website then sends the cookies back to the original website or to another website that recognises the cookies. Simply put – by using cookies, a website stores information about your visit to a website.

The website uses different categories of cookies for different purposes. Essential cookies are necessary for the basic functionality of the website. Therefore, the administrator cannot do without the processing of essential cookies for the website to perform its basic function. Necessary cookies can be processed by the Administrator without the consent of the website visitor. All other cookies can only be processed by the Administrator with the consent of the website visitor, which can be revoked (refused) at any time in the cookie settings. However, withdrawal or non-consent may affect the browsing experience on the website.

2. VOLUNTARY PROVISION OF DATA
The data subject provides the Administrator with his/her personal data voluntarily. Failure to provide personal data may affect the Controller’s ability to enter into a contract or to provide the data subject with services that are based on necessary knowledge of information about the data subject, including personal data.

3. RIGHT TO WITHDRAW CONSENT
If the processing of personal data is based on the data subject’s consent, the data subject may withdraw his or her consent to processing at any time by sending an electronic message to (info@augmentor.cz) or by using the link provided in the commercial communication. The withdrawal of consent does not affect the processing of personal data carried out by the Controller on the basis of another legal title, in particular for the purpose of performance of a contract, provision of a service or processing that was based on consent until the moment of its withdrawal.

4. PERSONAL DATA PROCESSORS

Please note, however, that due to the changing nature of some service providers, it is not possible to list all current and future personal data processors by name. Therefore, the above list of processors may change over time.

5. HOW PERSONAL DATA IS PROCESSED
The controller and, where applicable, its processors process personal data manually (in electronic form) and electronically by automated means.

6. DATA SUBJECTS’ RIGHTS
The data subject has the following rights:
a) Right of access to personal data
The data subject has the right to obtain confirmation from the Data Controller as to whether or not personal data relating to him or her are being processed and, if so, the right to obtain access to such personal data and to the following information:
1. the purposes of the processing of personal data;
2. the categories of personal data concerned;
3. the recipients or categories of recipients to whom the personal data have been or will be disclosed
4. the intended period for which the personal data will be stored or, if this cannot be determined, the criteria used to determine that period;
5. the existence of the right to request from the Controller the rectification or erasure of personal data concerning the data subject or the restriction of their processing or to object to such processing;
6. the right to lodge a complaint with a supervisory authority;
7. any available information about the source of the personal data, unless it is obtained from the data subject.
The data subject shall also have the right to request from the Controller a copy of the personal data processed, provided that the rights and freedoms of others are not adversely affected. The Data Controller may charge a reasonable fee based on administrative costs for additional copies at the request of the data subject. Where the data subject makes a request in electronic form, the information shall be provided in the electronic form commonly used, unless the data subject requests otherwise.

b) Right to rectification
The data subject has the right to have inaccurate personal data concerning him or her rectified by the controller without undue delay. Taking into account the purposes of the processing, the data subject shall have the right to have incomplete personal data completed, including by providing an additional statement.
c) Right to erasure (right to be forgotten)
The data subject shall have the right to have the controller erase the personal data concerning the data subject without undue delay and the controller shall be obliged to erase the personal data without undue delay if one of the following grounds applies:
1. the personal data are no longer necessary for the purposes for which they were collected or otherwise processed;
2. the data subject withdraws the consent on the basis of which the personal data were processed and there is no other legal ground for the processing;
3. the data subject raises legitimate objections to the processing of the personal data;
4. the personal data have been unlawfully processed;
5. the personal data must be erased to comply with a legal obligation under European Union or Czech law;
6. the personal data have been collected in connection with the offer of information society services on the basis of consent given by the child.

d) Right to restriction of processing
The data subject has the right to have the controller restrict the processing in any of the following cases:
1. the data subject contests the accuracy of the personal data, for the period necessary to allow the Controller to verify the accuracy of the personal data;
2. the processing is unlawful and the data subject refuses to erase the personal data and requests instead that the use of the personal data be restricted;
3. the Data Controller no longer needs the personal data for the purposes of the processing, but the Data Subject requires it for the establishment, exercise or defence of legal claims.
e) Right to data portability
The Data Subject has the right to obtain personal data concerning him or her that he or she has provided to the Data Controller in a structured, commonly used and machine-readable format, and the right to transmit such data to another Data Controller without hindrance from the Data Controller, if:
1. the processing is based on consent to the processing of personal data or the processing of personal data for the purposes of concluding and performing a contract with the data subject; and
2. the processing is carried out by automated means.
In exercising his or her right to data portability, the data subject has the right to have the personal data transmitted by the Controller directly to another Controller, if technically feasible. The right to data portability shall not adversely affect the rights and freedoms of other persons.

f) Right to object
The data subject has the right to object to the processing of personal data. If the data subject objects validly to processing for direct marketing or profiling purposes, the personal data will no longer be processed for these purposes.
The objection will be evaluated and the Data Controller will then inform the data subject whether the objection has been granted and the Data Controller will no longer process the data or that the objection was not justified and the processing will continue. The processing will be restricted until the objection is resolved.
g) Right not to be subject to automated decision-making, including profiling
The data subject has the right not to be subject to any decision based solely on automated processing, including profiling (i.e. any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to the data subject), which has legal effects concerning him or her or similarly significantly affects him or her. This right shall not apply where the automated decision is necessary for entering into, or performance of, a contract between the data subject and the Controller or is based on the data subject’s explicit consent; however, in such cases, the data subject shall have the right to human intervention in the automated decision by the Controller, the right to express his or her point of view and the right to contest the automated decision.

h) Right to lodge a complaint with the supervisory authority
The data subject has the right to lodge a complaint against the processing of his/her personal data by the Controller with the supervisory authority, which for the Czech Republic is the Office for Personal Data Protection, Pplk. Sochora 27, 170 00 Prague 7.

8. Final Provisions
The Controller has not appointed a Data Protection Officer.
The Controller is entitled to unilaterally amend this Privacy Policy and the processing of personal data.
This Privacy Policy shall take effect on 1 January 2025.
